The following was again before the House in third reading: CS FOR HOUSE BILL NO. 320(FIN) "An Act relating to search and rescue training and search and rescue parties; requiring certain search and rescue volunteers to be considered state employees for purposes of workers' compensation coverage; and allowing political subdivisions to elect to provide workers' compensation insurance coverage for search and rescue personnel." Representative Gara moved and asked unanimous consent that CSHB 320(FIN) be returned to second reading for the specific purpose of considering Amendment No. 1. There being no objection, it was so ordered. The Speaker stated that, without objection, CSHB 320(FIN) would be returned to second reading for all amendments. 2008-03-04 House Journal Page 2178 Amendment No. 1 was offered by Representative Gara: Page 1, line 12, through page 2, line 5: Delete all material and insert: "* Sec. 2. AS 18.60.120 is amended to read: Sec. 18.60.120. Search and rescue parties. Upon being notified that a person is lost, injured, killed, or is in need of immediate rescue, each of the following [THE COMMISSIONER OF PUBLIC SAFETY OR A DESIGNEE] may appoint a competent person to organize, direct, and guide a search and rescue party and may authorize a person to participate in a search and rescue party under this section: (1) the commissioner of public safety or the commissioner's designee; (2) a peace officer; (3) a fire fighter; in this paragraph, "fire fighter" has the meaning given in AS 09.65.295; or (4) a person authorized by a political subdivision of the state [FOR THE PURPOSE OF RESCUING OR RETRIEVING THE PERSON OR THE PERSON'S REMAINS]." Representative Gara moved and asked unanimous consent that Amendment No. 1 be adopted. Representative Meyer objected. The question being: "Shall Amendment No. 1 be adopted?" Amendment No. 2 was offered by Representative Gara: Page 2, line 14, following "others.": Insert "This immunity does not apply to the benefit of any political subdivision of the state that fails to provide workers' compensation coverage for the person." Representative Gara moved and asked unanimous consent that Amendment No. 2 be adopted. Representative Meyer objected. The question being: "Shall Amendment No. 2 be adopted?"
